About these terms

These terms are an agreement between you and GrowthDwar, a sole proprietorship, owned by Navneet Pandey, at 3-3-303, 1st floor, KesarKunj, Mahankali Street, Rangrez Bazar, Secunderabad, Hyderabad, Telangana 500003. “You” means the business that opens a GrowthDwar account, and anyone who uses it for that business.

By creating an account or using GrowthDwar, you agree to these terms and to our Privacy policy.

Your account

• You must be at least 18 and use GrowthDwar for a business or profession.
• Give true details and keep them up to date.
• Keep your password safe. You are responsible for what happens in your account, including what your team members do.
• Tell us straight away if you think someone else has got into your account.

Free trial

Every new account gets a 14-day free trial. No card is needed.

When the trial ends, choose a plan to keep going. If you don’t, sending messages and making changes are paused. Your information is kept, so you can carry on when you choose a plan, and you can ask us to delete it at any time.

Plans and payment

• Plans differ in how many WhatsApp numbers and team members you can have, and whether calling is included. The current plans and prices are shown in the app before you pay.
• Prices are in Indian rupees. Taxes are added where the law requires.
• Plans are paid monthly in advance through Razorpay and renew each month until you cancel.
• If a payment fails, we will remind you. If it still isn’t paid, sending messages and making changes are paused until it is.
• We may change our prices. We will tell you at least 30 days before a new price applies to you.
• Refunds follow our Cancellation and refund policy.

WhatsApp and Meta

GrowthDwar connects to the WhatsApp Business Platform, which is run by Meta. When you connect a number:

• You also agree to the WhatsApp Business Terms, the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy.
• Meta charges for some messages, such as offers and reminders. Meta bills these to the payment method you add in WhatsApp Manager. They are not part of our price, and we don’t set them.
• Message only people who have said yes to hearing from you, and stop when they ask you to.
• Meta reviews message templates and can limit, pause or block a number. We can’t overturn Meta’s decisions and are not responsible for them, but we will help where we can.

Fair use

Don’t use GrowthDwar to:

• send spam, or message people who haven’t agreed to hear from you;
• sell or promote anything illegal, or anything the WhatsApp Commerce Policy forbids;
• mislead, cheat or harass anyone, or pretend to be someone else;
• publish anything illegal, hateful, sexual or violent, or anything that breaks someone else’s rights;
• break into, overload, copy or take apart GrowthDwar, or get around its limits;
• resell GrowthDwar without our written permission.

If you do, we may remove the content, pause your account or close it. Where it is fair to, we will warn you first.

Your content and your customers’ data

• What you put into GrowthDwar stays yours: your text, photos, logo, contacts and chats.
• You allow us to store, show, copy and process it only as needed to run GrowthDwar for you, for example to publish your website or send your messages.
• Make sure you have the right to use everything you upload, such as photos and logos.
• You decide how your customers’ details are used, and you must handle them lawfully, including under India’s Digital Personal Data Protection Act, 2023. We handle them for you as our Privacy policy explains.
• The stock photos we suggest are free to use under their own licences, such as the Pexels licence.

Your website and web address

• Each website gets a free address like yourshop.growthdwar.com. Choose a name you have the right to use. We may change or take back a name that copies another brand or misleads people.
• If you connect a web address you own, it stays yours, and you are responsible for renewing it.
• You are responsible for what your website says, including prices, offers and claims.

AI features

Some features use AI to suggest text, replies or designs. AI can make mistakes, so check what it makes before you send or publish it. You are responsible for what you use.

Our service

• We work hard to keep GrowthDwar running and your information safe, but we can’t promise it will never be interrupted. Some breaks are needed for updates and repairs, and services we rely on, such as WhatsApp, can have problems of their own.
• We keep improving GrowthDwar and may change or remove features. If a change takes away something important that you pay for, we will tell you before it happens.
• Parts of GrowthDwar are built on open-source software, including Whatomate, which is licensed under the GNU Affero General Public License, version 3. The source code of those parts is available on request.

Cancelling and closing accounts

• You can cancel at any time. Your plan stays active until the end of the period you paid for.
• We may pause or close an account that breaks these terms or the law, or puts other people at risk.
• After an account is closed, we delete its information as our Privacy policy explains. Ask us for a copy of your data before you close it.

Our responsibility

• GrowthDwar is provided as it is. We don’t promise that it suits every purpose, or that it will bring a certain number of customers or sales.
• We are not responsible for indirect losses, such as lost profit, lost business or lost data, or for what Meta, payment providers or other services you connect do.
• If we are responsible for a loss, the most we will pay is what you paid us in the 12 months before it happened.
• Nothing in these terms limits anything the law doesn’t allow to be limited.
• If someone makes a claim against us because of your content, your messages or your breaking these terms, you agree to cover our costs.

Disputes

These terms are governed by the laws of India. If something goes wrong, please talk to us first. Most problems can be sorted out quickly. If we can’t agree, the courts in Hyderabad will decide.

Changes to these terms

We may update these terms. We will post the new version here and change the date at the top. For important changes, we will also tell you by email or in the app at least 15 days before they apply. If you keep using GrowthDwar after that, the new terms apply.
